Terms of Service and Acceptable Use Policy (TOS & AUP)

These Terms of Service and Acceptable Use Policy ("Terms") govern your use of services provided by Lawless Digital Marketing Ltd T/A thenet.ie ("we," "us," or "our"). By using our services, you agree to these Terms. These Terms may be updated from time to time.

1. Services Offered

We provide:

  • Website & Email Hosting
  • SEO & Marketing
  • Website Design & Development
  • Website Management
  • Domain Registration
  • Software tailoring including SSL Certificates and monitoring services etc.

2. Service Terms

  • Delivery: We strive to deliver all services in a professional and timely manner. Specific project timelines and deliverables will be outlined in a separate service agreement or proposal document.
  • Support: Monday–Friday, 9:30 AM–5:00 PM. After-hours support next business day unless arranged.
  • Payment: Invoices are issued according to the agreed schedule, and payment is due within 14 days unless otherwise specified. Late payments may lead to service disruption
  • Cancellation: You may cancel services with 30 days' written notice. Any outstanding charges or work performed up to the date of termination will remain payable.
  • Refunds: Due to the nature of our digital services, refunds are generally not provided once work has commenced. Exceptions may be made at our discretion in cases where no significant work has been delivered.
  • Confidentiality: We respect your confidentiality. Any sensitive information shared with us will be handled with strict confidence and not disclosed to third parties without your consent, except as required by law.
  • Client Duties: Clients must provide timely feedback, access, and assets as needed to facilitate project delivery. Delays in client response usually affect timelines.

3. Service Level Agreement (SLA)

  • Uptime: 99.9% for hosting (excluding maintenance/force majeure).
  • Response: Critical – 4h, High – 8h, Normal – 24h.
  • Resolution: Critical – 1 day, High – 2 days (others vary).
  • Monitoring: Hosting and core services continuously monitored.
  • Exclusions: Client-side errors or third-party issues not covered.

4. Acceptable Use

All services must comply with Irish and international law. The following are not permitted:

  • Illegal, obscene, threatening, or defamatory materials
  • Adult content, warez, pirated software, hacking/spamming tools
  • Background programs (e.g., IRC bots), outdated scripts, proxy/chat servers
  • Torrents, gaming servers, unauthorized file sharing
  • High resource use (e.g., sustained 25%+ CPU usage)
  • Bypassing security, DoS attacks, network scanning
  • Sending spam or spoofed emails

Usage Notes:

  • Hosting is for website files only—not general storage/backups.
  • Shared hosting is subject to fair use. High impact usage may be throttled.
  • Plan-specific limits (RAM, CPU, concurrent requests, inodes) apply.

5. Legal and Compliance

  • Intellectual Property: Clients must respect copyright/trademark laws.
  • Domains: Subject to IEDR, ICANN, and Nominet rules. Fees non-refundable.
  • Email: Includes spam/virus filtering; client monitors storage/quota.
  • SSL: Third-party issued. Two-year certs need annual re-validation.
  • Security: Unauthorized access attempts or attacks are prohibited.
  • Backups: Clients are responsible for data backups.

6. Miscellaneous

  • Liability: To the fullest extent permitted by law, Lawless Digital Marketing Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of business opportunities, loss of data, or any other commercial damages or losses, arising out of or in connection with the use of our services, websites, software, or any deliverables provided.
    You acknowledge and agree that Lawless Digital Marketing Limited shall not be required to provide any form of financial compensation or reimbursement for such losses, regardless of whether the possibility of such damages was foreseeable or advised.
  • Force Majeure: We are not responsible for indirect losses (e.g. data loss, loss of business).Force Majeure includes events such as cyberattacks, system failures, strikes, or natural disasters, which may delay or prevent service delivery.
  • Support Limits: Shared hosting includes 5 tickets/month or 60 mins.
  • Policy Updates: Terms may change; continued use is acceptance.
  • Complaints: Submit to [email protected]. Reviewed within 5 working days.
